PRIVACY AND DATA PROTECTION POLICY

Within the scope of the registration, access, and use of the website orangemetal.fr, Orange Metal – Constructions Métalliques, Sarl – Branch in Portugal, hereinafter referred to as Orange Metal, acting as the data controller, may request the User to provide their personal data, namely information supplied by the User that allows Orange Metal to identify and/or contact them (“Personal Data”).

As a rule, Personal Data is requested when the User submits a request for information or a quotation, in which case only the name, email address, and telephone contact are collected.

Personal Data is also requested when the User submits a request to subscribe to the newsletter, in which case only the name and email address are collected. The User may cancel their newsletter subscription at any time through the newsletters received, without prejudice to other means of exercising their right to erasure as described below.

The personal data collected will be processed for the purpose of responding to requests for information and/or quotations. Personal data will be retained for as long as the purpose for which it was collected remains valid or for the legally defined period (where applicable). Within the scope of processing User data, Orange Metal may use third-party entities subcontracted by it to process User data on its behalf and in accordance with its instructions, in strict compliance with the law and this Privacy Policy.

Orange Metal undertakes to subcontract only entities that provide sufficient guarantees for the implementation of appropriate technical and organizational measures, ensuring the protection of User rights and strict compliance with legal requirements regarding data protection. All entities subcontracted by Orange Metal are bound by a written agreement regulating, namely, the subject and duration of processing, the nature and purpose of processing, the type of personal data, the categories of data subjects, and the rights and obligations of the parties.

Orange Metal undertakes to ensure that User data is processed in compliance with the general principles applicable to the processing of personal data and in accordance with this Privacy and Data Protection Policy, namely that the data will be:

• Processed lawfully, fairly, and transparently in relation to the User;
• Collected for specified, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes;
• Adequate, relevant, and limited to what is necessary for the purposes for which they are processed;
• Accurate and kept up to date whenever necessary, with all appropriate measures adopted to ensure that inaccurate data is erased or rectified without delay, taking into account the purposes for which they are processed;
• Stored in a manner that permits identification of the User only for the period necessary for the purposes for which the data is processed.

The processing of personal data carried out by Orange Metal is based on clear and objective lawful grounds, such as:

• The performance of a contract to which the User is a party, or pre-contractual steps at the request of the User;
• Compliance with a legal obligation to which Orange Metal is subject;

Orange Metal undertakes to ensure that User data is processed only under the conditions listed above and in compliance with the principles previously mentioned.

When the processing of User data by Orange Metal is based on User consent, the User has the right to withdraw their consent at any time. However, the withdrawal of consent does not affect the lawfulness of the processing carried out by Orange Metal based on the consent previously given by the User.

To ensure the security of User Data and maximum confidentiality, we process the information provided in a strictly confidential manner, in accordance with our internal security and confidentiality policies and procedures, which are periodically updated as necessary and in accordance with legally established terms and conditions.

Considering the nature, scope, context, and purposes of data processing, as well as the risks arising from processing to the rights and freedoms of the User, Orange Metal undertakes to apply the necessary and appropriate technical and organizational measures, both at the time of defining the means of processing and during the processing itself, to protect User Data and comply with legal requirements.

Users, as data subjects, have a set of rights which, under certain conditions, they may exercise:

• Right to rectification;
• Right to erasure;
• Right to restriction of processing;
